THE CITY separately is taking issue with FAA’s view that it must keep the airport running until 2023. FAA contended in an initial “Director’s Determination” that the city accepted a federal grant in 2003, which obligates Santa Monica to keep SMO open until at least 2023. But the city argues that the airport grant it accepted in 2003 was part of a larger grant awarded in 1994. “The city received a payment in 2003 at the conclusion of the projects funded in the 1994 grant,” city officials said.

THE CITY OF SANTA MONICA is still waiting for a decision from the Ninth Circuit Court of Appeals on its appeal to reinstate a ban on large business jets at the Santa Monica, Calif. FAA argued that “the city provides no basis for the extraordinary demand” to alter the preliminary injunction against the business jet ban.
