EACS aircraft in seizure disagreement
M.A. Al Kharafi and Sons has attempted to seize a VIP-configured A340-200 belonging to Libya's Executive Authority for Air Cargo and Special Flights (EACS).
ch-aviation has reported that the Kuwaiti firm is demanding USD945 million from the Libyan government as compensation awarded by an Egyptian court in 2006 after a failed joint-partnership venture.
EACS, however, has argued that its aircraft has diplomatic immunity and cannot be seized.
This is due to EACS being a unit of the internationally recognised Libyan government.
M.A. Al Kharafi and Sons was awarded the compensation after the Libyan government failed to give the firm land as part of a 90-year Build-Operate-Transfer (BOT).
A decision on the fate of the aircraft is expected shortly.
